Gift Face Terms of Use

1. About these Terms

These Terms of Use ("Terms") apply to Gift Face, the free web game at confi.ai/giftface and its related pages, including shared video links and the Hall of Fame (together, the "Game").

The Game is operated by Confi Technologies, Inc., a Delaware corporation ("Confi," "we," "us," or "our").

These Terms cover only the Game. The Game has no account. Other Confi products have their own terms, which do not apply here.

By using the Game, you agree to these Terms and acknowledge the Gift Face Privacy Notice at confi.ai/giftface/privacy. If you do not agree, do not use the Game.

2. Who can play

The Game is for adults only. You must be at least 18 years old to use it, and the Game says so on its start screen and when you add a photo. If you are under 18, do not use the Game and do not upload a photo.

3. What the Game is

• The Game asks a few light questions, assigns you a cartoon holiday character, and makes a short animated video. You may add a photo of a face, or play without one.
• Videos, characters, titles, and verdicts are jokes. They are computer-generated entertainment. They are not statements of fact about you or anyone else, and they are not advice of any kind.
• The Game is free. There is no account, no purchase, and no prize.
• We may change, pause, or end the Game, or any part of it, at any time.

4. Your photos and content: the rules

"Your Content" means any photo, first name, or answer you put into the Game.

You may only upload a photo that you have the right to use. In particular:

• Use your own face, or the face of someone who has given you permission. By uploading, you confirm that everyone shown in the photo has agreed to it being used in the Game.
• Do not upload a photo of anyone under 18.
• Do not upload a photo of a celebrity or other living public figure, or use anyone's likeness to suggest that they endorse, appear in, or are connected with anything.
• Do not upload a photo you do not have the right to use, such as a photo taken by someone else that you are not allowed to copy.
• Do not use the Game to harass, mock, embarrass, sexualize, impersonate, or threaten anyone, or to create content that is unlawful, hateful, or deceptive.

You are responsible for Your Content and for what you share. We may remove any content, or block any share link, that we believe breaks these Terms or the law.

5. The limited licence you give us

You keep ownership of Your Content.

You give Confi a limited, non-exclusive, royalty-free, worldwide licence (with the right to let our service providers do this on our behalf) to store, copy, process, display, and transmit Your Content only as needed to operate the Game for you: to render your video, to show it to people who open your share link, to build the link preview for your share link, and to keep the Game secure.

This licence lasts only while we keep Your Content under the Privacy Notice, and ends when it is deleted. It does not cover copies that you or the people you shared with have saved or posted elsewhere.

We will not use your photo for advertising, sell it, license it to anyone, or use it to train artificial intelligence models.

6. Sharing

• Your photo stays on your device unless you tap Share.
• When you tap Share (even if you then cancel), a small copy of your face, plus the few details needed to place it in the video, goes with your video so friends can watch it. Anyone who has your share link can watch the video.
• Copies that people download, screenshot, or repost are outside our control.

7. Famous historical figures

Some parts of the Game show famous historical figures (for example, long-dead rulers, presidents, and writers). These are original cartoon artworks based on public-domain portraits, used for parody and entertainment. They are not statements about any real person, and they do not mean that any person, estate, museum, or institution endorses, sponsors, or is connected with the Game.

8. No affiliation

Gift Face is an original game by Confi. It is not affiliated with, endorsed by, or sponsored by any other holiday video, greeting, or face-swap service or its owners. Any third-party names or marks belong to their owners.

9. Our content

The Game, including its characters, artwork, animation, music, text, and code (but not Your Content), belongs to Confi or its licensors. You may save and share the video the Game makes for you for your personal, non-commercial use. You may not otherwise copy, sell, or reuse the Game or its content.

10. Report a problem or request a takedown

• If you see a video that uses your face without permission, uses a child's photo, or otherwise breaks these Terms, email admin@confi.ai with the share link. We will review it and remove the content if it breaks these Terms or the law.
• Copyright complaints (DMCA). If you believe content in the Game infringes your copyright, send a notice under 17 U.S.C. 512 to our designated agent: Confi Technologies, Inc., Attn: DMCA Agent, 513 W Shoreview Drive, San Ramon, CA 94582, United States, admin@confi.ai. Your notice must include the information required by that law. We may remove content in response and may block repeat infringers from the Game.

11. Deleting your face copy

• Every shared face copy is deleted automatically 60 days after the first time you tap Share. Sharing again does not extend it.
• You can ask us to delete it sooner by emailing admin@confi.ai with your share link.
• See the Privacy Notice for other data and your rights.

12. Things you must not do

• Use the Game if you are under 18.
• Break the photo rules in Section 4.
• Interfere with, overload, scrape, or attack the Game, or try to access data that is not yours.
• Use the Game for any commercial purpose, or in a way that breaks the law.

13. Disclaimers

THE GAME IS PROVIDED FREE, "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, CONFI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE GAME WILL BE AVAILABLE, ERROR-FREE, OR THAT ANY VIDEO WILL LOOK A CERTAIN WAY.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CONFI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE GAME. CONFI'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE GAME WILL NOT EXCEED FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FOR FRAUD, OR FOR ANYTHING ELSE THAT CANNOT BE LIMITED UNDER APPLICABLE LAW. IF YOU LIVE IN NEW JERSEY, SECTIONS 13 TO 15 APPLY ONLY TO THE EXTENT NEW JERSEY LAW PERMITS.

15. Indemnity

If you knowingly break Section 4 (for example, by uploading someone else's face without permission) and a third party makes a claim against Confi because of it, you are responsible for the losses that result, to the extent the law allows.

16. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in California, except that either party may bring an individual claim in small-claims court. There is no arbitration requirement and no class-action waiver.

17. Changes

We may update these Terms by posting a new version at this address with a new "Last Updated" date. If you keep using the Game after that, the updated Terms apply.
